Snapr (herein after referred to as "Snapr", "we," "our," or "us") is a service which powers a number of different mobile apps and services that include photo and / or video sharing.
This mobile app, website or service that directed you to the Terms of Use Agreement herein (“Agreement” or “Terms of Use”) is powered by Snapr and your use is governed by this Agreement. Please read the following important Agreement.
Snapr receives, distributes and displays user generated content form numerous sources which may include any information, text, graphics, photos or other materials uploaded or downloaded (collectively referred to as “Content”).
Snapr allows social interaction with this Content through various mobile applications, websites, APIs, and third-party applications and services (“collectively referred to as Services”). This Agreement applies to all visitors, users and others who access the Services (“Users,” “you,” or “your”).
The Content you submit, post, or display will be able to be viewed by other Users of the Services and through third party services and websites. You must only provide and share Content that you are comfortable for other Users to view and interact with under these Terms of Use.
By contributing Content, viewing, or using the Services, in any way you signify that you have read, understood, and agree to be bound by these Terms of Use irrespective of what country you reside in.
You agree that you are solely responsible for violating any of your obligations under these Terms of Use and for the consequences of any such violation (including any loss or damage that Snapr may suffer). If you have contributed Content that violates these Terms of Use you recognize our right to terminate your account and remove all access to the Services and your Content.
Snapr is rated 13 years of age or older. You must be 13 years of age or older to create a Snapr account and use the Services. Users aged between 13-18 should seek parental guidance before agreeing to these Terms of Use.
Content may be considered objectionable, and in direct violation of these Terms of Use, if it contains frequent and intense offensive language, intense cartoon, fantasy or realistic violence, intense mature horror, and suggestive themes; plus sexual content, nudity, and references to alcohol, tobacco and drugs which may not be suitable for children under the age of 17.
If the image includes GPS co-ordinates and timestamps please ensure this corresponds to the time and location the image was taken.
To create a Snapr account you are required to provide a valid email address that lawfully belongs to you. You must not impersonate someone else and should ensure that any registration information is correct and up to date.
The security of your login details is solely your responsibility. You will be responsible for all activity under your account.
Your account and the Service must not be used for any illegal or unauthorized purpose.
By contributing Content you warrant that such Content belongs to you, and that you have not uploaded copyrighted or other such material owned by any third-party. Snapr shall have no liability for copyrighted or any other Content that you choose to upload.
Snapr respects the intellectual property rights of others and will remove material if, at our discretion, we believe it to be in breach of copyright law.
If you do not have the right to submit Content it may subject you to liability. Snapr will not be responsible or liable for any use of your Content.
Through the use of the Services, the Content you submit will be able to be viewed, downloaded and reused by other users of the Services either directly or through third party services and websites. You should therefore only submit Content that you are comfortable sharing with others.
The Content must not be spam, machine- or randomly-generated, and must not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing).
By submitting Content through the Services you grant Snapr a worldwide, non-exclusive, perpetual, irrevocable, fully paid, royalty-free license (with the right to sub-license and transfer) to use, copy, process, modify, publish and distribute such Content in any media or distribution methods (now known or later developed) in connection with the Services or promotional materials.
Without limiting any of those representations or warranties, Snapr has the right at its sole discretion (though not the obligation) to, (i) refuse or remove any Content that, in Snapr’s reasonable opinion, violates any Snapr policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Services to any individual or entity for any reason.
Snapr may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.
You acknowledge that by providing you with the ability to view and distribute Content through the Services, Snapr is acting solely as a conduit for the distribution of such information, and is not undertaking any obligation or liability relating to the Content or the User’s activity. Snapr cannot guarantee that the Content is accurate. Any use or reliance on the Content accessed or obtained by you through the Services is at your own risk. User and Third Party Content do not represent advice, opinions or beliefs of Snapr.
Snapr takes no responsibility for your use of the Content / Services, or harm suffered from your viewing or access to User contributed Content. We may not monitor or control the Content, and we cannot take responsibility for such Content.
By accessing the Services or following links to third-party websites you may be exposed to Content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. While Snapr does not endorse and reserves the right to remove such Content, you acknowledge that you use the Services at your sole risk and agree that Snapr shall not have any liability or be held responsible for such Content and that you nonetheless may be exposed to such materials.
When you upload Content you may be broadcasting your current location to others. Snapr takes no responsibility for any kind of harm or loss that may come to you or others as a direct or indirect result of the use of the Service.
Content presented to you as part of the Services may be protected by intellectual property rights which are owned by the person providing that Content to Snapr (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told, in a separate agreement, that you may do so by Snapr or by the owners of that Content.
Snapr uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
The technical processing and transmission of the Service, including Your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
Some of the Service's features are powered by third party API’s from Google, Twitter, Foursquare, Tumblr and Facebook. The use of which is also governed by each parties terms. The terms of use are located below (or such other URL as may be updated by their respective owners).

The Services include certain services that are available via your mobile phone. You are responsible for any fees charged by your mobile carrier for using Mobile Services.
You agree not to damage, disable, automate, release computer viruses, mine information about other users, modify, hack, or otherwise interfere with or impair the normal operation of the Services.
You must not decipher, decompile, disassemble, reverse engineer or otherwise attempts to derive any source code or underlying ideas or algorithms of any part of Snapr Trademarks.
The Snapr name and logo(s) are the exclusive property of Snapr, Ltd. or its affiliates. The trade names, trademarks and service marks owned by us, whether registered or unregistered, may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion. Nothing relating to the Services should be construed as granting, by implication, estoppel or otherwise, any license or right to use any of our trade names, trademarks or service marks without our express prior written consent.
Either party may terminate use of the Services provided by Snapr with or without cause at any time and effective immediately. Snapr shall not be liable to any User or third party for termination of use of the Services.
Please review our Privacy Policy which governs the use of personal information and to which you agree to be bound as a User of the Services.
You agree to indemnify Snapr, its directors, contractors, subsidiaries, officers, licensors, affiliates and employees, against all claims and expenses, including costs and attorneys' fees, made by any third party arising out of your contribution to or access of Content or use of the Services, your violation of these Terms of Use, or the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity.
The Services are provided on an “as is” and “as available” basis, and you use them at your sole risk. Without limitation, Snapr makes no warranty that the Services will meet your requirements, that they will be error-free, secure, uninterrupted, timely, that the results will be accurate or reliable, or that the quality of the Services and Content will meet your expectations. Use Snapr at your own risk.
Please note that no advice or information obtained by you from Snapr personnel or through the Services shall create any representation, warranty or guarantee not expressly provided for in these Terms of Use.
In no event shall Snapr, its directors, officers, shareholders, employees or members be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, indirect, incidental, punitive, or consequential damages of any kind whatsoever; (ii) the cost of procurement or substitute products or services; (iii) damages for loss of use, profits, data, images, User Content or other intangibles; (iv) damages for unauthorized use, non-performance of the Services, errors or omissions; or (v) damages related to downloading or posting Content.
The failure of Snapr to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms of Use remain in full force and effect.
You represent and warrant that (i) your use of the Services will be in strict accordance with the Snapr Privacy Policy, with these Terms of Use and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the country in which you reside) and (ii) your use of the Services will not infringe or misappropriate the intellectual property rights of any third party.
These Terms of Use, which apply to any visitors, users and others who access the Services, provide that both you and Snapr agree to submit to the personal and exclusive jurisdiction of the courts located in Auckland, New Zealand.
